Frederique Dumas-Joyal is claiming her title as a lawyer, reveals the appeal for judicial review she filed against the Barreau du Québec on February 10.

Ms. Dumas-Joyal found herself in a media turmoil, that of the “influencers” of Tulum, last January. A video of a few seconds – posted online by the model Rachel Cantin – showed her with a red thong as a face covering.

“On December 30, 2021, (Frédérique Dumas-Joyal) takes a vacation to participate in a trip to Mexico which takes an unexpected turn and which is then the subject of a media crisis”, she admits in her legal request.

In addition to having cost him his job at the Autorité des marchés financiers (AMF), this situation seems to be hampering his entry into the profession. Frédérique Dumas-Joyal, who claims to respect all the conditions of admission, believes that the Bar is neglecting to grant her the “right (which she has) hard won”: her title of lawyer.

Imbroglio and professional contribution

Ms. Dumas-Joyal reportedly completed her Bar internship at the AMF last November. Her appeal goes further: she would have worked as a lawyer for the organization from the end of the month. Recall that she was fired at the beginning of 2022.

An article published by Droit-inc announced on January 7 that she was never entered on the Roll of the Order, due, in all likelihood, to the non-payment of her professional dues.

The appeal specifies that Ms. Dumas-Joyal would have paid her contribution between January 6 and 11 after realizing that her former employer had not assumed it. A clause in his employment contract would have specified that the AMF “supports” the payment of his contribution “in proportion to the months worked (sic)”.

“On or around December 13, 2021, (Frédérique Dumas-Joyal), modifies her Instagram biography to change the mention “lawyer to be” to the mention “avocate” since she is convinced that her professional contribution, the only missing step when she was registered on the Roll of the Order, has now been paid for by her employer. »

Hearing of the Committee for access to the profession

Frédérique Dumas-Joyal would have been summoned to a hearing of the Committee for Access to the Profession (CAP) on January 20, nine days after having paid her dues.

The Bar would refuse to grant her her title of lawyer until the hearing has taken place. Ms. Dumas-Joyal considers that the Committee is not empowered to suspend her entry into the profession, as she already meets the criteria for admission to the Bar.

“(Frédérique Dumas-Joyal) would like to point out that under no circumstances did the (Barreau du Québec) and the (Profession Access Committee) notify him that his registration was suspended, canceled or jeopardized before January 20, 2022, i.e. nine days after (she has met) all the admission requirements. »

“(The Bar) refuses or neglects to diligently perform its obligations because of a procedure illegally brought before the (Committee for Access to the Profession)”.

Frédérique Dumas-Joyal is representing herself in this litigation.
