“Defense lawyers shouldn’t say that. »commented on Tuesday, Attorney General François Molins in The Obsafter the publication, Monday, July 18, in The world from a forum of lawyers for some of the convicts of the special assize court, in the case of the November 2015 attacks. The text, entitled “The November 13 trial was not exemplary and the rights of the defense were abused”, took on the dimension of a firestorm in judicial circles and in the ranks of certain civil parties, while none of the convicted did not appeal the verdict.
The sentence that shocked the most seems to be the one that concludes the text: “The decision rendered by the special assize court of Paris is a political decision before being a legal decision. » “It is very serious to say of a court that it makes political decisions, taken in advance, and that it does not respect the rights of the defense or the principles of fair trial”denounced François Molins, Attorney General at the Court of Cassation.
The debate divided the ranks of the defense even before the publication. Was it the right time? Wasn’t the text likely to be felt as an attack ad hominem of the magistrates composing the court? Was it legitimate to denounce a verdict when the defendants had not chosen to challenge it by appealing?
