The court delivered its deliberation on Tuesday, June 7, 2022.
Found in an advanced state of thinness
The facts were known to the association on March 8, 2021. And the latter acted very quickly. Following a report, the Stéphane Lamart association appoints one of its investigators to carry out the first checks.
The investigator found that the two Shih Tzu-type dogs lacked care, food and water and were in an advanced state of thinness, with parasites and unkept glued hair. They lived in a garden filled with excrement and urine and had no basket or blanket.
Asked by 76actu, Stéphane Lamart specifies: “This situation, dogs left to their own devices outside, had lasted for a year, when the owner’s wife died. When we found the dogs, they were in such a state that we could not distinguish the head from the buttocks which were covered with hair. »
A dead dog in the garden
A dead dog was also in the owner’s garden. “The deceased dog was evacuated by a veterinarian. He had a piece of fabric 40 cm long in his stomach. According to the post-mortem report, the obstruction caused by the foreign body in the stomach, together with the cachexia and the lack of care, probably indirectly caused the death of the animal. The extreme cachexia of the animal demonstrated an obvious lack of care, according to the veterinarian, ”reports the association again.
He gives up his dogs without remorse
The dogs did not have a health book and were not identified, they were taken care of by the association.
The owner gave up the dogs without remorse, stating that he no longer had time to take care of them since the death of his wife.
The court rendered its judgment on June 7, 2022, therefore. “The defendant was found guilty and sentenced to a fine of €150 per dog for the acts of deprivation of care. In addition, he was sentenced to a fine of €35 per dog for the facts of keeping unidentified dogs. The man will also have to pay the Stéphane Lamart association €500 in damages and €300 in legal costs.
The confiscation of the two dogs was ordered.
And today how are the two dogs
Beyond the conviction, Stéphane Lamart indicates: “It was very important for us that the owner be found guilty and that the confiscation be ordered. Today, the two dogs are doing very well after the care received from our association. They are in a foster family who was impatiently awaiting this verdict in order to be able to adopt them. »
